This Privacy Policy applies when you interact with us through BabyQuip.com, the BabyQuip mobile application, and any other feature or service owned or controlled by BabyQuip, Inc. (“BabyQuip”, “we,” or “us”) that posts or includes a link to this Privacy Policy (collectively, the “Service(s)”). This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of personal information we receive from users of our Services and your choices. By accessing or using the Services, you consent to our Privacy Policy and our collection, use, and sharing of your information as described in this policy, our Terms of Use https://www.babyquip.com/terms, and any additional policies and terms you may agree to in connection with the Services.

Our Services are intended for a general audience and are not intended for use by individuals younger than the age of 18. We do not knowingly collect personal information from children younger than the age of 18.

1.Collection of Information

We and our third-party service providers and business partners may collect information from you directly and automatically when you visit the Services and from third parties. Some of this information may be considered “personal information” or “personal data” under various applicable laws. We consider information that identifies you as a specific, identified individual (such as your name, phone number, and e-mail address) to be personal information. We will also treat additional information, including IP addresses and cookie identifiers, as “personal information” or “personal data” where required by applicable law.

We may take your personal information and de-identify or pseudonymize it to make it non-personally identifiable, either by combining it with information about other individuals and/or by hashing the information or otherwise removing characteristics that make the information personally identifiable directly to you. We maintain and use de-identified or pseudonymized data without attempting to re-identify it, except where permitted by applicable law, such as to determine whether our de-identification processes satisfy legal requirements. We will treat de-identified or pseudonymized information as non-personal to the fullest extent allowed by applicable law.

1.1 Information You Provide Directly: We may ask you to provide certain personal information when you interact with the Services. This information may include contact information, such as your name, address, and phone number, demographic information, such as the age and gender of your children, or billing information, such as your credit card number and billing address.

We may also ask you to provide the contact information of another individual, such as when another person will be accepting, returning, or otherwise responsible for equipment you have rented. When you provide us with an individual’s contact information in this context, we will only use this information for the specific reason for which it was provided. If you believe that one of your contacts has provided us with your personal information and you would like to request that it be deleted, please contact us at inquiry@babyquip.com.

1.2 Information We Collect Automatically: We and third-party advertising companies and business partners may use a variety of technologies that automatically or passively collect certain information whenever you visit our Services or otherwise interact with us or our content (“Usage Information”). Usage Information may include the hardware model, browser, and operating system you are using, the URL or advertisement that referred you to the Service you are visiting, all of the areas within BabyQuip’s Services that you visit, your time zone, location information, and mobile network (if applicable), among other information. In addition, we automatically collect your IP address or other unique identifier (“Device Identifier”) for any computer, mobile phone or other device you use to access our Services. In some cases, we may directly collect location information through your device. You may be able to turn off the collection of location information through the settings on your device. Usage Information is generally non-identifying, but if BabyQuip associates it with you as a specific and identifiable person, BabyQuip treats it as personal information.

  • Web Beacons: Small graphic images or other web programming code called web beacons (also known as “pixel tags,” “1x1 GIFs,” or “clear GIFs”) may be included in our web pages and email messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or email can act as a web beacon. Web beacons or similar technologies may be used for several purposes, including, without limitation, to count visitors to the Service, to monitor how users navigate the Service, to count how many emails that were sent were opened, or to count how many particular links were actually viewed. We use similar tools to collect such information from mobile devices. In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.
  • Embedded Scripts: An embedded script is a programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service.
  • BabyQuip may record session interactions with Babyquip.com user interfaces, including what pages you visit on the Service, how long you visit those pages, the links you click, and your path through the Service, for website analytics purposes, solely for our internal business purposes, to improve our Services.

1.3 Location Data: In some cases, for example when you opt-in to collection of location data through our mobile applications or your web browser, we may directly collect location information through your device. You may be able to turn off the collection of location information through the settings on your device. However, please note that we may still be able to collect or infer your approximate location through other information we collect, such as IP address. In addition, some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of the device used to access our Services.

1.4 Information from Third Parties and Social Media Platforms: We may receive information about you from third parties, including Independent Quality Providers and marketing companies. We also host or facilitate interactions with social media platforms, like Facebook, YouTube, Pinterest, TikTok and Instagram. You may have the opportunity to log in through or otherwise connect your social media account. When you interact with social media through the Services, we will receive information about you from the social media service and you will be choosing to share information about your interactions with BabyQuip with that social media service. Note that through the social media features we have on the Services, third-party social media companies may be able to collect information about your interactions with our Services, including your IP address or other device identifiers, and which pages you visit on the Services regardless of whether or not you affirmatively interact with the social media company or whether or not you are logged into (or have) an account with them.

2. Purpose and Use of Information We Collect

We may use non-personal information for any purpose, including for advertising, research, and marketing purposes. We also use information that we collect, including personal information and Usage Information, as disclosed in this Privacy Policy and as follows:

  • to provide the Services to you and allow you to participate in the features we offer, including for the purposes of fulfilling your order, sending you an order confirmation, processing your payment, and communicating with you about your order;
  • to tailor and target content, recommendations, advertisements, and offers we display to you, both on BabyQuip and elsewhere online, and to send you communications with information about our products, and Services;
  • to contact you to respond to your customer service questions, feedback, or requests or to provide you with technical support;
  • to improve our Services and for legal, regulatory, and internal business purposes;
  • to fulfill any other purpose consistent with this Privacy Policy or for purposes disclosed to you at the time of collection or with your consent.

3. Sharing of Information

BabyQuip may share non-personal information, such as information about use of our Services, aggregated user statistics, or hashed and other de-identified or pseudonymized information with third parties, in our discretion. We do not share personal information with unaffiliated third parties for those third parties' own marketing purposes without your consent.

In addition, we may share the information we have collected about you as disclosed at the time you provide your information or your consent, and as described elsewhere in this Privacy Policy, including:

  • At Your Request/Publicly Posted Content. We may share information when you direct us to do so, such as if you choose to write a review on an Independent Quality Provider’s profile, link your account with a social networking service or other third-party application or feature through which information is shared, or if we present you with an opportunity to receive marketing offers from a third party. We do not control the actions of third parties, and you post content and share your information at your own risk.
  • Third Parties. We may share your information with third parties who provide Services on our behalf to help with our business activities. These companies are authorized to use your personal information only as necessary to provide these Services to us. These Services may include payment processing and sending marketing communications. Our third-party service providers may be located in the U.S., Canada, or other foreign jurisdictions.
  • Sweepstakes, Contests and Promotions. We may offer sweepstakes, contests, or other promotions (any of which, a “Promotion”) that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal information may be disclosed to co-promotion partners, third parties or the public in connection with the administration of such Promotion, including in connection with winner selection, prize fulfillment, as required by law, or as permitted by the Promotion’s terms or official rules.
  • Business Transitions. We may disclose your information in connection with a corporate transition such as a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, including during the course of any due diligence process. By providing your personal information, you agree that we may transfer such information to the other entity in such a transaction without your further consent.
  • Administrative and Legal Reasons. We reserve the right to use or disclose any information as needed to satisfy or fulfill our obligations under any law, regulation or legal request; to protect the integrity of the BabyQuip; to fulfill your requests; to cooperate in a law enforcement investigation, an investigation on a public safety matter, or an investigation into claims of intellectual property infringement; to protect and defend the legal rights and/or property of BabyQuip and any of our corporate parents, subsidiaries, affiliates, and shareholders, or our Services, any of its users, or any other party; or, in an emergency, to protect the health and safety of Users or the general public.

4. Third-Party Advertising and Analytics Providers

We work with third-party service providers, such as network advertisers, ad agencies, analytics providers, and other advertising partners to serve BabyQuip ads on our Services and third-party websites, apps, and elsewhere online and offline, to send direct mail to customers whom we think may be interested in our Services, and to provide us with information regarding use of and traffic on our Services (including without limitation the pages viewed and the actions users take when visiting our Services) and the effectiveness of our advertisements. These third parties may set and access their own tracking technologies on your device (including cookies), and they may otherwise collect or have access to certain information about your use of the Services (such as Usage Information and Device Identifier). Some of these parties may collect personal information over time when you visit our Services or other online websites, and some may connect the information they collect through cookies and with other information about you, including your name and mailing address, for the purpose of sending you direct mail promotions.

We may also share certain information, such as device identifiers, Usage Information, and other types of de-identified or pseudonymized information with third-party advertising companies, analytics providers, and other third parties for the purpose of serving you more relevant ads on and off the Services. In addition, we and our third-party service providers may use this information to perform matching with third-party cookies to provide targeted online marketing.

We may use a variety of companies to serve our advertisements. Some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising and you may want to visit the following webpages, which provide “opt-out” mechanisms for participating companies: optout.networkadvertising.org and http://www.aboutads.info/choices. Options for Our Mobile App: Mobile devices may contain settings that allow you to disable tracking advertising and/or analytics. You can opt-out from interest- based advertising on your mobile device through your mobile device settings. In addition, the digital advertising industry has provided the ability for mobile users to register their intent not to receive targeted advertising at http://www.aboutads.info/appchoices.

Please note that opting out through these mechanisms does not opt you out of being served advertising and you will continue to receive generic ads while online.

5. “Do Not Track”

Please note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online Services that you visit. When you choose to turn on the “Do Not Track” settings in your browser, your browser will send a signal to websites, analytics providers, advertisements networks, plug-in providers, and other web service providers you encounter while browsing to stop tracking your activity. 6. Security

We follow commercially reasonable standards to protect the personal information submitted to us. We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. However, no data transmission over the Internet, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure, and BabyQuip cannot ensure or warrant the security of any information we collect. 7. Data Retention

We will only retain your personal information for as long as your account is active or as necessary to provide you Services, comply with our legal obligations, resolve disputes, and enforce our agreements.

8. Consent to International Transfer

BabyQuip is based in the United States. Please be aware that information we collect will be transferred to and processed in the United States and other countries. BabyQuip makes no representation that this Privacy Policy or the practices described in it comply with the laws of any other jurisdiction.

By using the Services, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States and other jurisdictions, for which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to laws in those jurisdictions. Your information will also be disclosed to third parties as described in the “Sharing of Information” section above.

9. Your Choices and Access/Correction/Deletion Requests

If you want to know whether we hold any of your personal information or would like to access, correct, or request deletion of your personal information, you may email us at inquiry@BabyQuip.com.

You may also sign-up to receive our email newsletter. If you would like to discontinue receiving this information, you may update your email preferences by using the “Unsubscribe” link found in emails we send to you, or by contacting us at inquiry@BabyQuip.com. Please note that we reserve the right to send you certain communications relating to your account or use of the Services, such as administrative and services announcements. These transactional account messages may be unaffected if you choose to opt out from marketing e-mails. To opt-out of receiving our direct mail or catalogs, you may send us an email at inquiry@babyquip.com or call us at 201-695-8094. We will honor those requests, but please understand that it may take 10 days for such mailings to end.

Text Messages: If you sign up to receive SMS, MMS, or RCS messages from BabyQuip, you may unsubscribe by replying “STOP”.

Push Notifications: With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can elect to stop receiving those messages by changing the notification settings in the BabyQuip app or on your mobile device.

10. Changes to This Privacy Policy

To the extent permitted by applicable law, we reserve the right to change or modify this Privacy Policy at our discretion at any time. We will notify you of any material changes by posting the changed or modified Privacy Policy on our Services. We may also provide notice to you in other ways, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified. Your continued use of the Services after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will, to the fullest extent permitted by applicable law, constitute your consent to those changes. However, we will provide notice and obtain your consent (opt-in or opt-out) if required by law. We encourage you to regularly review this Privacy Policy for the latest information on our privacy practices.

  • Notice to Nevada Residents.
  • BabyQuip does not currently sell your covered information as those terms are defined under applicable Nevada law. You may still submit an opt-out request and we will honor that request as required by Nevada law if BabyQuip were to engage in such a sale in the future. You may do so by emailing us at inquiry@babyquip.com and putting “Your Nevada Privacy Rights” in the subject field of your request.

  • Notice to Australian Residents. If you are a resident of Australia, the following information applies.

    Likely Overseas Disclosure – Personal Information we collect may be disclosed to overseas recipients that are located in the United States or any other country in which we or our subcontractors maintain facilities. We rely on your consent to facilitate this disclosure in the United States and other jurisdictions, where laws regarding processing of personal information may be less stringent than the Australian Privacy Principles. In certain cases, we may rely on appropriate safeguards such as standard contractual clauses as a basis for the overseas disclosure.

    Your Rights to Access and Correct Your Personal Information - You have the right to access and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may request access and corrections of inaccuracies in your personal information we have in our custody or control by emailing or calling to us at inquiry@babyquip.com or (201) 695-8094. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.

    Third Party Advertising. As discussed above, we work with certain third-party advertising companies in connection with our online advertising and those companies may set cookies or other tracking technologies in connection with providing advertising related services to us. Please refer to EDAA’s choice page at www.youradchoices.com to learn more about your choices related to advertising with respect to participating EDAA member companies.

    Complaints and Resolving Concerns - If you have any questions or comments about this Privacy Notice or if you otherwise have a question or complaint about the manner in which we or our service providers treat your personal information, you may contact us by emailing inquiry@babyquip.com or calling us at (201) 695-8094.

    You may also obtain further information about your privacy rights from the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au. OAIC has authority to investigate complaints and claims for compensation in appropriate cases.

    You may withdraw consent at any time (subject to legal or contractual restrictions and reasonable notice). Subject to certain limits set out in the applicable laws, Canadian residents also have the right to request access to the personal information that BabyQuip collects and to update or correct personal information if it is inaccurate. We may need to verify your identity before implementing your request.

    Subject to applicable law, if you are a Canadian resident and would like to submit a request to access, correct, or update your personal information, or to withdraw consent to the processing of your personal data, you must submit your request to our CTO by sending an email to inquiry@babyquip.com or calling (201) 695-8094. You may also use this contact to submit any requests for information on our privacy practices or to submit a complaint regarding our practices.

    Your request or complaint must include your full name, street address, city, province, postal code, and an email address so that we are able to contact you if needed regarding this request.

    We cannot properly process requests or complaints that do not come through the designated request mechanism or do not contain sufficient information to allow us to process your request. You may also be required to take reasonable steps as we determine from time to time in order to verify your identity and/or the authenticity of the request. Once your request is processed, absent exemptions, we will provide you with details regarding what personal information we have, how it is used, and with which third parties it is shared.

  • Notice to Quebec Residents.
  • All BabyQuip personnel handling personal information will be subject to a duty of confidentiality and to ensure that all personal information is handled in accordance with standard security measures. By using the Service, you acknowledge and agree that your personal information will be transferred outside of Quebec.

    We may use certain technologies that allow you to be located. Such as, when using our mobile app you may opt-in to the collection of your location in order to help you locate products near you. You may turn off the collection of precise location information at any time through the settings on your device.

    We will only use your personal information for the purposes stated at the point of collection or as otherwise noted in this privacy policy. Subject to applicable law, if you are a Quebec resident and would like to submit a request to be informed, access, erasure, rectification, or to withdraw or restrict processing, you must submit your request to inquiry@babyquip.com or by calling (201) 695-8094. You may also use this contact to submit any requests for information on our privacy practices or to submit a complaint regarding our practices. Your request or complaint must include your full name, street address, city, province, postal code, and an email address so that we are able to contact you if needed regarding this request.

    Transfers: Personal information we collect may be transferred to, and stored and processed in, the United States or any other country in which we or our affiliates or subcontractors maintain facilities. Transfers of personal data to a third country without an adequacy decision (as that term is understood pursuant to Article 45 of GDPR) are required to be subject to appropriate safeguards such as standard contractual clauses. In certain cases, we rely on your consent to facilitate transfer, processing, and storage of your data in the United States and other jurisdictions, where laws regarding processing of personal information may be less stringent than the laws in the EEA, UK, and Switzerland.

    Withdraw consent: If we have collected personal information with your consent, you have the right to withdraw that consent at any time.

    Access: You have the right to request access to personal information we collected about you and information about its sources, purposes, and sharing.

    Correction: You have the right to request that we correct the personal information we hold about you if it is inaccurate or incomplete.

    Erasure: You have the right to request that we erase data we have collected from you. Please note that we may have a reason to deny your deletion request or delete data in a more limited way than you anticipated, e.g., because of a legal obligation to retain it.

    Portability: You have the right, in certain circumstances, to request that we provide your personal information to you in a format that can be transferred to another entity.

    Restrict Processing: You have the right, in certain circumstances, to request that we limit our processing of your personal information if you are (1) contesting the accuracy of your personal information, (2) asserting that our processing is unlawful; (3) asserting that we no longer need to keep the information for reasons related to the establishment, exercise, or defense of legal claims, or you object to our processing. You have the right, in certain circumstances, to request that we limit our processing of your personal information if you are contesting the accuracy of your personal information; asserting that our processing is unlawful; asserting that we no longer need to keep the information for reasons related to the establishment, exercise, or defense of legal claims, or you object to our processing.

    Object: You have the right to object to our processing if we are processing your personal information based on legitimate interests, using your personal information for direct marketing (including profiling), or processing your personal information for purposes of scientific or historical research and statistics.

    Verification Procedures: We must verify your identity for everyone’s protection, so we may require you to provide us with verification information prior to accessing any records containing personal information about you. We do this by:
    -Asking you to provide personal identifiers we can match against information we may have collected from you previously and confirm your request using the email or telephone account stated in the request; or
    -Having you submit your request through your account page, which will automatically verify your identity and will result in faster processing of your request.

    We will use the information you provide for verification only for the purpose of verification. We may have a reason under the law why we do not have to respond to your request or respond to it in a more limited way than you anticipated. If we do, we will explain that to you in our response.
